    The FDA is continuing to behave like a bureaucracy Out-Of-Control

    The FDA is proposing certain regulations to impede, restrict, and ban dietary supplements. They intend to do this by regulation, not by laws – this is an end-run around Congress.

    Remember, laws are made by Congress – not by bureaucracies!

     

    Your local policeman doesn’t make the laws – he just enforces them – and the FDA is the policeman for foods an drugs. The job of the FDA is to enforce the laws that Congress makes – not to make up laws all on it’s own!

    Many of you have already written your representatives: Sen. Durbin Is Still After Your Vitamins – In ‘Stealth-Mode’ and have received encouraging replies from some – but the FDA is taking little notice of the wishes of the House and of Congress, instead choosing to behave like a schoolyard bully – determined to get it’s way no matter what.

    This issue is coming to a head now, with the “Comment Period” set to end on December 2nd. After that time your letters and comments will have all the effect of (as we country-folk say) “spittin’ into the wind.”

We encourage our subscribers to read the letter and to follow the advice to make one final push to contact all elected representatives and to object strenuously to this blatant, bullying power-grab by the FDA – the paid lap-dog of the Pharmaceutical industry.

    The FDA has presented a troubling issue regarding nutritional supplements.

    A GUIDANCE issued by the FDA calls for such incredible constraint on the supplement industry that, if enacted, could truly have a profound effect on the availability of a vast array of products.

    Since virtually all of us, including myself, use dietary supplements, I urge you to take immediate action by sending the attached letters to your representatives. A text version is also at the end of this email – you may cut and paste it into an email to your elected representatives in Washington, but you will need to fill out a brief contact form first.  I believe faxing is the best way to be heard. Feel free to change the letters and personalize them.

    The following are a few highlights of the Guidance document:

    The FDA’s draft Guidance requires companies to possess exorbitant amounts of information concerning their existing dietary supplements to prove that New Dietary Ingredient (NDI) notifications are not required for the products they are currently marketing. In many cases, it will be impossible to gather such information, thereby threatening the future availability of numerous dietary supplement products on the market today.

    In order to market a product that contains a new dietary ingredient, manufacturers will be required to submit a tremendous amount of information concerning historical use of the ingredient or conduct a multitude of animal and human studies which are overly burdensome and costly. Establishing such excessive requirements is both contrary to Congressional intent and unnecessary given the safety record of dietary supplements over the past few decades.

    Any change in the manufacturing process of a dietary ingredient that results in chemical alteration of such ingredient or a change in specifications of the ingredient, regardless of how insignificant the alteration or change is, will require the submission of a NDI notification. This will discourage manufacturers from using the most advanced and efficient manufacturing technologies and pursuing methods that can improve the safety and effectiveness of dietary supplement products.

    Any increase of the amount of a dietary ingredient in a dietary supplement or any change in formula of a dietary supplement, regardless of how minute or insignificant, will require the submission of a NDI notification. This will discourage the innovation of new products.

    To My Elected Representative:

    My name is                                                                         , and I am a constituent in your District.  I am deeply concerned about the Food and Drug Administration’s (FDA) recently issued Draft Guidance document entitled New Dietary Ingredient Notifications and Related Issues.

    Dietary supplements are an important part of my and my family’s health-maintenance routine.  We consider access to affordable supplements to be a crucial part of our healthy lifestyle to mitigate the need for expensive medical procedures and promote good health to improve and extend our lives.

    The FDA’s issuance of its draft Guidance is very troubling because it signals a dramatic shift in its policy towards dietary supplements, and I believe the FDA is attempting to establish a system of pre-market approval for these products.

    It has been nearly two decades since enactment of the Dietary Supplement Health and Education Act of 1994 (DSHEA).  Back then the industry was in a fight for its life because of the FDA’s insistence on using the vague standards in the food additive provisions as a means of removing from the marketplace ingredients it disapproved of even for reasons unrelated to safety.  The FDA abused its authority, and through a lot of hard work, we won the battle.

    Now we find ourselves having to defend the very existence of this industry once again.  While DSHEA purposely had drafted in it a sensible and reasonable system by which the agency must be notified of the marketing of a new dietary ingredient and the basis for which the manufacturer believes that a dietary supplement containing such dietary ingredient will reasonably be expected to be safe the FDA has taken positions in its draft Guidance that indicate that it intends to treat dietary ingredients as food additives once again. 

    Even more disturbing is the FDA’s insistence that any change in the formula of a dietary supplement that contains a new dietary ingredient will require the submission of a NDI notification.  The agency has announced its intention that all dietary supplements containing new dietary ingredients be pre-cleared by the FDA.  This is contrary to Congressional intent in passing DSHEA. 

    If the FDA deems it necessary to make such drastic changes in the way dietary supplements are regulated, I think it should have to go through Congress.  This is a bureaucracy that is out-of-control. It would needlessly restrict access to safe dietary supplement products, and is a job killer for the dietary supplement industry.

    As a concerned constituent in your District, I am requesting that you do everything in your power to stop the FDA from enforcing DSHEA in a manner that is contrary to Congressional intent and in a manner that has the potential to destroy an industry that has brought so much good to so many people.

    All is well – remain calm! Don’t worry – be happy! The crisis is over – there’s nothing to be concerned about.

    Such is the going “line” from our government sources such as the U.S. EPA which monitored radiation levels until June and then stopped – er, I should say, “returned to routine RadNet operations.”

    Even the Mainstream Media has, for the most part, shunned any additional reporting about the ongoing mess that the Fukushima Nuclear Disaster has become. Reporting has been sparse, and articles that have made it into print have tended to “disappear” quickly, being replaced promptly by more titillating stories about the shenanigans of Wall Street protesters and the foibles of Republican presidential hopefuls.

    Recent news stories about long term cancer risk from Fukushima fallout caused little stir, received little airtime, and went away quickly.

    An research paper published in the Journal of the European Geosciences Union indicates that some 79% of the initial fallout went into the Pacific ocean – with 2% of it continuing on to North America and Europe. Most Mainstream Media outlets that reported on this did so from the angle of “Whew! What good luck – it all went into the ocean!” without bothering to ask the obvious: We got 2% of how much?

    Think about it: 2% of a dollar isn’t much money – but 2% of a million dollars… well, that’s a whole different ballgame!

    And then there are some less mainstream reporters who have more alarming information to share with us – EnviroReporter.com is a website created by Michael Collins where he regularly updates readers with articles and videos graphically describing worrisome radiation levels being found all across the U.S. He presents video documentation of radiation findings in Los Angeles air and rain, Grand Canyon Rain, Japanese vegetable juice, and more.

    Since it is obvious that barring any further surprises the worst of the immediate fallout has passed and we are now enjoying a much gentler, but very long-term fallout and contamination of our environment from Fukushima our personal health focus must shift from the concern of immediately protecting our thyroid glands from radioactive iodine fallout to a longer-term strategy of protecting ourselves from the low levels of radioactive contamination that are certain to assail us for years to come.

    Immediate first aid for thyroid in the event of nuclear emergency is of course Potassium Iodide supplementation – we have written about it before, and even our government agrees.

    Longer term thyroid protection comes from maintaining iodine levels at “sufficiency” – this can be achieved with Iodoral and measured with Iodine Testing.

    Radioactive iodine is not the only contaminant to be concerned about though – radioactive cesium and other isotopes are being found and we must be prepared to protect ourselves from these dangers as well.

    Modifilan was reportedly developed in Russia by scientists at the State Rehabilitation Institute, where victims of the Chernobyl nuclear catastrophe underwent treatment. It is helpful in Detoxifying the body from heavy metals, radioactive elements, free radicals and toxins. It is also an excellent source of organic iodine.

    Modifilan would be an excellent addition to the daily health regimen of anyone with potential for exposure to low-level radioactive fallout.

  • What Do You Need For Healthy Bones?

    Bone Health Or Bone Death?

    We get a lot of questions about osteoporosis – it is a very confusing and rightfully frightening subject for older people.

    Big Pharma takes advantage of that confusion and fear to offer a variety of drugs that are so dangerous that if they were subjected to the same intense scrutiny by the FDA that mere vitamins and supplements are they would be instantly banned!

    Big Medicine is a willing accomplice to Big Pharma, using such things as “bone density tests” to terrorize women into agreeing to take some variety of a bone-killing bisphosphonate drug.

    Did I just say “bone Killing“?

    Yes! These drugs “work” by actually killing one kind of bone cell – here is an explanation from Wikipedia:

    Bone undergoes constant turnover and is kept in balance (homeostasis) by osteoblasts creating bone and osteoclasts destroying bone. Bisphosphonates inhibit the digestion of bone by encouraging osteoclasts to undergo apoptosis, or cell death, thereby slowing bone loss.

     

    This rather reminds me of that famous quote from the Vietnam War years: “It became necessary to destroy the town to save it” (that quote has transformed over the years into “We had to destroy the village in order to save it.”) It seems that Big Pharma has adopted that strategy, saying “We have to kill your bone cells in order to save your bones.”

    Yikes – what a strategy! A strategy only Big Pharma could get away with and only the FDA could approve of!

    Has Big Medicine never heard of “preventive medicine”?

    One of Dr. Myatt’s long-standing patients, Joyce, wrote recently to say that she was being pressured to accept one of the more recent bisphosphonate offerings and to ask Dr. Myatt’s opinion. Here is her question and Dr. Myatt’s answer:

    HI  I WANT TO ASK YOU A QUESTION. I was told that I have osteoporosis after having a bone density test, it is not real bad they did want to put me on more calcium and vitamin D3 but I think there is enough in my Maxi – Multi’s. They also wanted to put me on a once a year treatment of Reclast  given I V for 20 min. Because I don’t trust them I said no. Any way all I wanted to know is if there is enough calcium & vitamin D 3 in my Maxies.  Thank you Joyce.

    Wow… Here’s the scoop.

    Maxi Multi’s contain enough cal:mag for almost everyone except post-menopausal women.

    The recommendations for post menopausal females is 1200-1500 mg/day calcium, 500-800 mg/day.

    In order to achieve this dose, most women add 3 caps per day of Cal-Mag to their protocol.

    You might not need the additional if your diet contains enough extra calcium and magnesium.

    Also, strontium has been found to work as well as drugs for building bone.

    Now, just in case anyone thinks I am exaggerating the dangers of bisphosphonate drugs, I have taken the following information from the U.S. National Library of Medicine a government website that bills itself as “The World’s Largest Medical Library” and as a resource for conventional medical doctors:

     

    What side effects can this medication cause?

    Zoledronic acid may cause side effects. Tell your doctor if any of these symptoms are severe or do not go away:

    • redness or swelling in the place where you received your injection

    • red, swollen, or teary eyes

    • constipation

    • nausea

    • vomiting

    • diarrhea

    • stomach pain

    • loss of appetite

    • weight loss

    • heartburn

    • mouth sores

    • excessive worry

    • agitation

    • depression

    • difficulty falling asleep or staying asleep

    • fever, chills, and other signs of infection

    • white patches in the mouth

    • swelling, redness, irritation, burning, or itching of the vagina

    • white vaginal discharge

    • numbness, burning, or tingling in fingers or toes

    • hair loss

    Some side effects can be serious. If you experience any of the following symptoms, call your doctor immediately:

    • rash

    • hives

    • itching

    • swelling of the eyes, face, lips, tongue, throat, hands, arms, feet, ankles, or lower legs

    • difficulty breathing or swallowing

    • upper chest pain

    • irregular heartbeat

    • numbness or tingling around the mouth

    • sudden tightening of muscles

    • unusual bruising or bleeding

    • painful or swollen gums

    • loosening of the teeth

    • numbness or heavy feeling in the jaw

    • poor healing of the jaw

    • dull, aching pain in the hips, groin, or thighs

    Zoledronic acid may cause other side effects. Call your doctor if you have any unusual problems while taking this medication.

    Being treated with a bisphosphonate medication such as zoledronic acid injection for osteoporosis may increase the risk that you will break your thigh bone(s). You may feel pain in your hips, groin, or thighs for several weeks or months before the bone(s) break, and you may find that one or both of your thigh bones have broken even though you have not fallen or experienced other trauma. It is unusual for the thigh bone to break in healthy people, but people who have osteoporosis may break this bone even if they do not receive zoledronic acid injection. Talk to your doctor about the risks of receiving zoledronic acid injection.

     

    Please read the last paragraph again: “Being treated with a bisphosphonate medication such as zoledronic acid injection for osteoporosis may increase the risk that you will break your thigh bone(s).”

    Does this sound like a drug that anyone should be taking?
